If a child is injured through the negligence of another, he or she will bring a claim through the parent or guardian. Most cases resolve without a lawsuit. If a case does go to suit than the Complaint will list the parent or guardian as the plaintiff with the injured child listed by initials only. In Kentucky, it is commonplace to have a parent or guardian pursue a case against a defendant and file a lawsuit if necessary.
