Defense lawyers who are smarter than me — tell me what I’m missing on this one. In fairness, they did admit some other things. Just thought this was interesting on one of my fall cases.

The Request for Admission

I know, as a defense attorney, you’re supposed to object to a lot of stuff. I don’t know about this one, though.

I basically said: “Hey, listen. Admit that you have to keep the premises of the business safe.”

The response was no.

I’m not sure if I like that. Let me go ahead and say this is denied, and we’re going to have a court tell us whether or not we have to make a business safe.

What I Would Have Done

The easy thing to do would just be: “Yeah, we have an obligation to make our business safe. We’re not saying we were safe under the circumstances of this particular fall. But yeah, we’re supposed to make the business safe.”

Seems like a weird thing to be fighting.
