I litigate big and small cases. More lawyers need to be filing lawsuits in my opinion.

My friends hire me which is pretty cool. CASE 1: 20k worth of property damage. Insurance says the depreciation is 1k. Expert says it’s 8.5k. Insurance tried to negotiate without hiring and expert and folded a few weeks before trial. Paid the 8.5k as I told them I’m not negotiating. CASE 2: Insurance offers 3k. 7k would have resolved. They said no more money after 3k. I filed suit. They just paid 10k a week later. Very reflective of how insurance operates. I litigate big and small cases. More lawyers need to be filing lawsuits in my opinion #law #attorney #lawyer

Should I hire a lawyer for a small property damage case or an insurance case?

As a personal injury lawyer, I have counseled clients through a wide range of situations, from minor incidents to substantial cases. The question of whether to hire a lawyer for a small property damage or insurance case often arises, and there isn’t a universal answer but it never hurts to have solid legal advice. The decision largely depends on the specific circumstances of the case, including its complexity, potential liability, and the financial stakes.

In some cases, a property damage or insurance issue may appear minor but can evolve into a complex situation that could benefit from professional legal expertise. For instance, even in a minor automobile accident, if it’s not clear who was at fault, or if you or another party involved has suffered injuries that might have long-term implications, a lawyer can be invaluable. A good personal injury lawyer can help navigate the complexities of liability and insurance law, and ensure your rights are protected.

The process of dealing with insurance companies can also be fraught with challenges. Insurance adjusters have their own set of interests to protect, and clients may be concerned that payouts are not handled with their best interest in mind. A seasoned lawyer is skilled at negotiating with insurance companies, fully aware of the tactics they might use, and can help you secure a fair settlement.

How do I know how big my case is or if it is worth pursuing?

Sometimes seemingly minor property damage issues may involve multiple parties, contributing factors, or undisclosed circumstances that can further complicate the case. There could be underlying legal issues that you may not be aware of that a professional can help bring to light.

There is a practicality issue to consider. Legal services come at a cost, and you must assess if the potential gain from a case outweighs the legal fees. For smaller property damage cases, hiring a lawyer may not always be financially viable. Some cases may be adequately handled through your insurance company or small claims court without the need for a lawyer. Fortunately, you can usually request a free assessment from a personal injury lawyer to help you figure out if you have a case worth pursuing.

Remember that many lawyers, especially in personal injury and insurance cases, work on a contingency basis, which means they get paid only if they win your case or secure a settlement. So, it’s possible to consult with a lawyer to discuss your case without any upfront fees.

While it may not always be necessary to hire a lawyer for minor property damage or insurance cases, there are circumstances where legal counsel is beneficial. It’s always wise to consult with a lawyer to help you understand your options and ensure you’re making the best decisions based on the specifics of your situation.
