Different seasons see different lawsuits. I file a lot of slip and fall lawsuits in the fall. This makes sense because people slip in winter and the statute of limitations in Kentucky for a premises liability case is one year. I post regularly encouraging property owners to take care during winter, but they do not listen. Then the lawsuits come. Here are the past five lawsuits I have filed with a brief description:

Slip and Fall Cases

  1. Slip and Fall versus Wendy’s (franchisee) over ice. Their adjuster tried to argue with me that the Norton West End Hospital Bill was too high so he wasn’t accounting for the retail bill (contrary to KY Law). I told him that would not go over well in our community. He also argued the store was made as safe as it possibly could have been because the city was under a weather emergency due to snow. I told him that if the owner could not make the property safe they should not be selling hamburgers. Head, neck and knee injury.
  2. Slip and Fall versus a Property Owner and Manager over ice. There is this new trick to operate your businesses out of states where it is difficult to get information. In this case Wyoming. Too bad for this defendant that my private investigator is good and tracked him down in Tennessee. Fractured lumbar spine.
  3. Slip and Fall versus Retail Store over ice. Defendant in this case seems to grasp severity of my client’s hip fracture. Filed to preserve the statute of limitations. Would expect defendant carrier to tender all available limits due to severity of injury. If they don’t I’ll argue they did not protect their insured and that could go haywire for them.

Personal Injury and Car Crash Cases

  1. Premises liability lawsuit versus a gym. Out of state law firm asked me to file a lawsuit on behalf of a man who injured his finger working out. The gym placed a jump box right below a fan. You know where this is going. Man jumps on box, raises his hand, gets sliced. I anticipate this will be resolved.
  2. Car Crash with fractured elbow versus disputed liability driver. I filed a lawsuit and they immediately changed their mind :). At fault carrier tendered their $25,000.00 policy triggering my clients underinsured motorist coverage. We sent a Coots Subrogation letter and I think they will waive subrogation.

It is IMPORTANT to litigate

I file lawsuits and litigate cases. If you have a lawyer that does not file and litigate it is my opinion that you don’t have a lawyer. Instead you have someone that is trying to churn and burn your case or is afraid of the courthouse. This ends up costing the client money. And our entire job as personal injury lawyers is to get our clients paid. I have tried 59 cases in various courthouses. It does seem harder and harder every year to get cases to trial, but I will keep swinging as long as it is in the best interest of the client.
