I got punched at work by the owners son. I was sitting in a chair he wanted and he started yelling at me and punched me while I was sitting in the chair. Went to the hospital and I had a black eye and a broken nose. The next day went in to see what they were going to do about it, and they basically blamed me for “letting it happen”. Fast-forward to now, I heard from a friend that they are suing me for asking for money of upwards of 10k. What do I do? Because I never said that. I never asked for any of this. Can I be sued for that?

Got punched at work. Now they’re talking about sewing me

“This sounds like a workers compensation and battery case, but there has to be more to the story. Why did this person get punched? What is the backstory? Anytime you are sued it is smart to get a lawyer ASAP. If you don’t, the other side could get a default judgment. This person could also counter claim against the person that is pursuing them.”
Helpful Tips:
1. Consult a Lawyer: Given the seriousness of the situation, it’s crucial to seek legal advice. A lawyer can help you understand your rights and guide you through the legal process.
2. Document Everything: Keep a record of all interactions related to the incident, including any conversations, emails, or text messages. This could be important evidence if legal action is taken.
3. Seek Medical Documentation: If you haven’t already, ensure that your injuries are well-documented by a medical professional. This can serve as evidence of the assault.
4. File a Police Report: If you haven’t done so already, consider reporting the incident to the police. This can provide an official record of the incident and may be necessary for any future legal proceedings.
5. File a Workplace Incident Report: If your workplace has a procedure for reporting incidents, make sure you follow it. This can provide additional documentation of the incident.
6. Don’t Engage in Discussions About the Incident Without Legal Advice: It’s generally a good idea to avoid discussing the incident or any potential legal actions with your employer or their representatives without having a lawyer present or without getting legal advice.
7. Understand Your Rights: You have the right to a safe workplace, and being assaulted by a coworker (especially a superior or the owner’s son) is a serious issue. You may have grounds for a lawsuit yourself, or you may be able to file a claim for workers’ compensation, depending on the laws in your area.
