During Kentucky Derby week, attorney Brian Dettman offers three thoughts: know your rights if you’re in a rideshare crash, understand that bars can be liable for overserving (dram shop liability), and if you slip in heels, take pictures of your shoes and the conditions.
Big events create unique risks. Being aware of them can help protect you.

It’s DERBY week in Louisville, Kentucky! Here are my quick thoughts, as a personal injury attorney, that could help you in a bad situation.

Here are three thoughts from a personal injury lawyer in Louisville, Kentucky during Derby week. Number one: if you’re in a rideshare crash, you have to make sure you call the police and do not speak to the insurance companies without consulting with a lawyer. My second thought during Derby week is dram shop cases. Dram shop means that a bar or a restaurant overserves a person that they know is impaired or intoxicated. They’re responsible for making sure they have the right policies and protocols in place to prevent people from being overserved and then going out and hurting somebody. My third thought is that there’s going to be women wearing shoes that are probably difficult to walk in. If you’re involved in a slip and fall, you need to take a picture of your shoes and you need to consult with a lawyer to see if maybe there’s some comparative negligence in wearing some crazy shoes. But that doesn’t mean that the place can let it fall to junk. They’ve got to keep track of where these people are going. And there’s an argument to be made that the facility needs to know that women are wearing shoes that are difficult to walk in, so maybe they need to make it even a little bit safer.
