I received a call yesterday from a person represented by a criminal defense lawyer in her personal injury car crash case. She was unhappy that the criminal defense lawyer did not seem to know what he was doing. I told her I could not talk to her as she was represented and she needed to speak to her current lawyer and try to work things out. This frustrated her because she apparently could not get in contact with her lawyer.
She is probably going to get a fast/quick/cheap settlement from a lawyer that does not know what he is doing. I’m not saying all lawyers that do criminal defense AND personal injury are bad, but if you get the feeling your lawyer dabbles in any area of the law it’s likely not going to be pretty at the end of the day.
How To Tell If Your Injury Lawyer Is Good:
Here is a good gauge of whether or not a lawyer can handle your personal injury case: Has the lawyer tried a civil case in the past three years. If your lawyer has put a case in front a jury then he/she presumably knows what they are doing. If your lawyer tries criminal cases infrequently and has not tried a civil case in quite some time, then you are dealing with an amateur that dabbles. My guess is your settlement or verdict will suffer as a result.

I do not do any criminal defense work where people pay me. As a former prosecutor, I occasionally do pro bono criminal defense work for people that get a raw deal from the police for whatever reason. I don’t do criminal defense on a regular basis so I don’t know the intricacies. Could I represent a murderer and secure a $100,000.00 fee while doing probably not the best job? Yes. But that isn’t how I want to practice law. I do personal injury and car crash cases because I enjoy helping my clients put their lives back together.

Long and short. Whatever legal problem you have get someone that handles that specific type of law on a regular basis. That includes personal injury, bankruptcy, criminal defense, estates, and all other types of law.
