I mediated a slip and fall case yesterday.  My client fell as a result of water on the concourse of Bats Stadium.  She did not have health insurance.  As a result, getting medical treatment was difficult which led to increased problems and eventually surgery.  The defendant was not willing to accept liability, even after a pre-litigation statement, so suit was filed.  If the defendant had accepted responsibility and paid damages it is very likely my client’s health would have improved. It has not and now she is looking at a second surgery.

Mediation was ordered by the Court.  That is standard.  Taking offers of settlement that are less than medical expenses are not standard.  My client and I refused to do that yesterday.  I don’t know if there are other lawyers out there taking really bad offers to settle and thus setting the bar low, but I imagine that is the case.  Personal injury lawyers need to try slip and fall cases to get fair resolutions.  In the past five years I have tried more than 99% of other lawyers.  Looks like I’m set to T another one up.
