You can sue someone personally after a car accident in Kentucky. Your lawyer will file a Complaint at the courthouse that names the at-fault driver as a Defendant. This means that that at fault drivers insurance will assign a lawyer to defend them. If the at-fault driver’s insurance does not defend them in a lawful manner than you may be entitled to bad faith damages. I get asked all the time whether or not I sue people that do not have insurance. Unless someone has significant assets worth pursuing it does not make financial sense to sue people without money. Some lawyers will make a show of getting a one million dollar judgment against a defendant where they will not be able to collect. It’s basically a piece of paper that cost $2,000.00 that is worth nothing. People that don’t have insurance don’t usually have money worth pursuing. There are exceptions to this rule. I’ve seen doctors run around without insurance (or enough insurance). Those people are worth suing.
