You can sue your own insurance company for pain and suffering if there is no insurance available from the at-fault party AND you have uninsured motorist coverage. You can also sue if the other driver does not have enough insurance and you have underinsured motorists coverage. In Kentucky car insurance is mandatory, but a lot of people disregard this law. As a result, it is smart to have uninsured and underinsured motorist coverage to make sure you are fully compensated for injuries. This is especially relevant to motorcycles. Plenty of motorcycle drivers have been told they have “full coverage” only to later find out the coverage is substandard.
