Can I sue if I get hit by a car?
You can sue if you get hit by a car in Kentucky. This is called a pedestrian crash case and they are common in Louisville, Kentucky.
In order to sue you will need to have suffered an injury and not be at fault for the car hitting you. For example, if you are in a crosswalk and you have the little man telling you to come through and a vehicle hits you than that vehicle is at fault. If you are crossing Dixie Highway late at night in dark clothing in the middle of the street than it becomes a bit more difficult for you to pursue your case. If you are not at fault, the driver that hits you is responsible for your pain and suffering, medical bills, lost wages, and loss of future income. These same rules apply if you are riding a bike, riding in your wheelchair, or on a scooter.
