Texting and distracted driving are a growing problem in Kentucky, with the National Highway Traffic Safety Administration (NHTSA) reporting that in 2018, distracted driving was a factor in more than 4,000 crashes in the state. In addition, the Kentucky State Police have reported that more than half of all drivers aged 18-24 admitted to texting while driving.

Personal injury lawsuits related to texting and distracted driving are becoming increasingly common in Kentucky. In many cases, victims of these crashes have successfully sued the distracted driver, seeking compensation for medical bills, lost wages, and other damages. According to the Kentucky Justice Association, the average texting and distracted driving lawsuit in the state resulted in a settlement of over $2 million in 2019. To reduce the risk of similar personal injury lawsuits in the future, the state of Kentucky has implemented laws that ban all cell phone use while driving, with penalties for those who violate the law.
