Disclaimer: Ok, so this RARELY happens, but I had a case where my client helped his case by playing golf.  Full transparency: the golf was BEFORE his crash 🙂

I resolved a litigation car crash case two weeks ago.  The insurance company from the other side told my client he was at fault and they would not pay him anything for his shoulder injury.

Two lanes were merging into one and my client let a vehicle in front of him.  The defendant then jolted forward in front of my client.  She was trying to jump her turn in line.  The action forced my client to take a hard left.  He couldn’t avoid impact and his front right hit the defendants back left.

The defense hired a biomedical expert to say my client merely re-injured his shoulder and was having problems with the shoulder before the car crash.  The defense paid this doctor $9,000.00-$12,000.00 for this opinion and evaluation (I’ve blogged about it this egregious number in the past).

After hearing how “injured” my client was before the crash I asked my client for some videos of him engaged in physical activity BEFORE the crash.  He had a video of him playing golf and swinging the daylights out of a club.  Side note: he has a solid swing.

We see stuff on TV where the defense will follow someone that is supposedly injured doing physical activity.  But in this scenario, I had visual proof that my client wasn’t as hurt as their expert thought.  I sent it to their lawyer.  A week before trial they paid full policy limits to resolve the case.
