The majority of cases resolve out of court.  Having a lawyer that will go to court lets the other side know there is danger ahead should the insurance company not pay a fair sum to resolve the case.  There are good lawyers and bad lawyers.  If you get a bad lawyer or a lawyer that does not go to court the case and your eventual settlement amount will suffer.  Good out of court settlements should be the norm for good lawyers.  If an unfair settlement amount is offered before a trial I’d rather put the facts in front of a jury.
