A driver being convicted of DUI in Kentucky is a bit different than just getting a settlement. There are two aspects to a DUI case: criminal and civil. The criminal case is wherer the Commonwealth prosecutes the defendant. When the defendant takes a plea or goes to trial and loses there will be punishments. The civil portion is for monetary damages including pain and suffering, medical expenses, and lost wages/impairment. It is helpful in a civil case to have the defendant plead guilty. When this happens the civil lawyer can use that plea to show the defendant has accepted responsibility for being intoxicated. There will be two separate lawyers for the civil and criminal cases. The one you hire will be the civil lawyer and that should be a personal injury lawyer.
