Suing an Insurance Adjuster Personally: A First in 800 Lawsuits

Louisville Injury LawyerSuing an Insurance Adjuster Personally: A First in 800 Lawsuits

In nearly 800 lawsuits, attorney Brian Dettman had never sued an insurance adjuster individually. That changed when an adjuster was allegedly untruthful in handling a claim.

The lawsuit includes fraud allegations against the adjuster personally, plus claims against the insurance company for negligent hiring, training, and supervision.

Fellow attorneys took notice. ‘Watching this as I had a claims supervisor in the hot seat for a depo over adjuster fraud this morning – go get em,’ wrote one workers’ comp lawyer.

For injury victims: this is unusual, but it shows there can be accountability when insurance professionals cross the line from aggressive claims handling into dishonesty.

Suing an Insurance Adjuster for Fraud: A First in 800 Lawsuits

I filed close to 800 lawsuits over my career. Not once have I sued an insurance adjuster individually. That changes today. An insurance adjuster is being sued for fraud. So is the insurance company she works for and the defendants. Bad faith claims, fraud claims. When you’re not truthful in the handling of claims, that’s a very good way for me to file a lawsuit and sue everybody under the sun.
