A client of mine is frustrated with how the other side is treating her. She has a case that is arguably newsworthy and asked me if it would help her case if the news knew about it. How the Media and Injury interplay is a fascinating world. And keep in mind I’m married to a news reporter/anchor. Will A Media Story Anger The Judge?

It is almost axiomatic, but the Judge is VERY important to your case. If the case gets in the news would it make it more difficult for a jury to be picked? If so, might sit on the story until afterwards.

Will A Media Story Help My Case?

What are you seeking to gain out of telling the media about your injury case? As an injury lawyer my job is to recover money for people. You hire me for that. The Commonwealth of Kentucky investigates crimes and seeks justice under the laws. That is more “principle” than money in my opinion. Put yourself in a jurors shoes. If you see the news story will it look like the victim is trying to gain something or to shed light. If the latter I’m good with it. I don’t want it to look like the story is an attempt to gain something.

Should You Keep Your Injury Case In Your Back Pocket?

Most things I do are new school versus old school in the practice of law. I don’t wear suits or have a stuffy office. I do use internet management systems and provide full benefits to all employees. One of the only old school things I do is prefer not to try my cases in the media, absent an exceptional circumstance. Now if the media picks up the story or finds it on their own that is helpful. But there are negotiation strategies that can be implemented when a story is not out there for public consumption. And those strategies bring money to a case which is my main job.
