Can I sue a driver for negligence?
You can sue a Kentucky driver for negligence if they meet all the elements of a negligence claim. There are four: duty, breach, causation, and damages. Duty means the other driver needs to drive in a reasonable manner in the roadway. They breach that duty by running into you and causing your injuries (damages). You can sue a driver if they run into your car, motorcycle, truck, or simply your body. The at fault driver is then responsible for your compensation. An insurance company or jury will award you damages for pain and suffering, medical expenses, loss of income, loss of future earnings, and property damage.
